Host Terms

These terms apply if you list a venue on Gatherland. They add to our Terms of Service, which also apply to you. Listing is free. We take a commission on completed bookings only, at the rate shown on /host/pricing.

1. Definitions

1.1 "We" and "us" means Astera Technology Limited, which operates Gatherland, company number 80623911, Unit A2, 19/F, Max Share Centre, 367–373 King's Road, North Point, Hong Kong.

1.2 "You" or "host" means the person or business that lists and operates a venue. If you list on behalf of a business, you confirm you are authorised to bind it.

2. Verification

2.1 Before your listings go live, we verify your business registration, your identity and your payout account.

2.2 Keep these details up to date. We may ask you to verify them again, and may pause your listings until you do.

3. Accurate listings

3.1 Your listing must be accurate and complete, including photos, address, capacity, facilities, prices, minimum hours or headcount, add-ons, house rules, deposit and cancellation policy.

3.2 Photos must show the actual venue as it is now.

3.3 Keep your calendar up to date. Block times that are not available, using manual blocks or iCal sync. You are responsible for any double booking caused by an out-of-date calendar.

3.4 You choose the venue's booking mode (instant book or host confirms) and cancellation policy (Flexible, Standard or Strict). The policy shown at the time of booking applies to that booking.

3.5 The exact floor and unit are shown to guests only after a booking is confirmed. Do not include them in public listing text or photos.

4. Lawful operation

4.1 You are solely responsible for making sure your venue and its use comply with the laws of Hong Kong.

4.2 It is your responsibility to hold, and keep current, any licences, permits and approvals required to operate your venue and to offer the activities and add-ons you list, and to comply with their conditions.

4.3 It is your responsibility to arrange any insurance appropriate to your venue and activities. We do not provide insurance for hosts or guests.

4.4 You are responsible for the safety of your venue, including keeping exits clear, keeping equipment in safe working order and not admitting more people than the venue's capacity.

4.5 You must not allow your venue to be used for gambling or any illegal activity.

4.6 We may ask for evidence of the matters in this section and may suspend a listing while we review it.

5. Honouring bookings

5.1 Once a booking is confirmed, you must make the venue available as described, for the full time booked, in a clean and safe condition.

5.2 Host-confirms venues. You have 24 hours to accept or decline a request. If you do not answer in time, the request expires and the guest is not charged.

5.3 For self check-in venues, make sure the entry instructions are correct. The platform sends them to the guest by email and WhatsApp before the start time.

5.4 Answer guest messages promptly.

5.5 Do not ask guests to pay, or to book, outside the platform for a booking made through it, or for a guest you met through the platform.

6. Cancelling a booking

6.1 Avoid cancelling confirmed bookings. If you cancel, the guest receives a full refund, including any deposit and credit used.

6.2 You are charged a cancellation fee, calculated as shown on /host/pricing. We may deduct it from your future payouts.

6.3 No cancellation fee is charged if the booking is cancelled under the severe weather rule: Typhoon Signal No. 8 or above, or a Black Rainstorm Warning, in force at any time from three hours before the start until the start.

6.4 Repeated cancellations may lead to suspension under section 15.

7. Guest cancellations

When a guest cancels, the refund follows your venue's cancellation policy (see the Cancellation Policy). You receive the share of the booking amount that is not refunded to the guest, as shown in your payout statement.

8. House rules

8.1 You may set house rules, for example on noise, smoking, food and drink, decorations and cleaning. They must be shown on your listing before booking.

8.2 House rules must be lawful and must not discriminate against guests.

8.3 You cannot enforce a rule that was not shown on the listing at the time of booking.

9. Security deposits and claims

9.1 You may set a refundable security deposit. It is shown to guests before they pay and is held by us, not by you.

9.2 To claim against a deposit for damage, overtime or extra cleaning, report it within 48 hours of the booking's end, with photos and any other evidence, such as receipts or quotes.

9.3 We tell the guest about the claim and give them a chance to respond. We then decide how much, if any, of the deposit is paid to you. Claims made after 48 hours, or without evidence, may be refused.

9.4 The deposit is the limit of what we can pay you from the platform for a claim. This does not affect any other legal rights you have against the guest.

10. Payouts

10.1 Guests pay us the full amount at booking. We hold it and release your payout 48 hours after the booking ends, less our commission, provided there is no open dispute.

10.2 Payouts are paid to your verified payout account. The time for the money to reach your account after release depends on our payment provider and your bank. There is no minimum payout amount.

10.3 Each payout comes with a statement showing the bookings, amounts and deductions.

10.4 We may hold or adjust a payout if a guest reports that the venue was seriously not as described, if a refund is due, or if we suspect fraud. We may deduct cancellation fees, refunds we decide are due, and amounts paid to you in error.

10.5 You are responsible for your own tax affairs.

11. Commission

11.1 We charge a commission on completed bookings only. The current rate is shown on /host/pricing.

11.2 We will give at least 14 days' notice before changing the commission rate. The rate in force when a booking is made applies to that booking.

12. Platform-only offers

You may choose to offer prices or extras available only on the platform. If you do, honour them for every booking made under the offer.

13. Reviews

13.1 Guests with a completed booking may review your venue. You may reply publicly. Replies must follow our Review Policy.

13.2 You must not offer guests money, discounts or other benefits for a review, ask them to change or remove a review, or write reviews of your own venue or a competitor's.

14. Guest personal data

14.1 You receive guests' contact details only to handle their booking. Use them only for that purpose, keep them secure and do not use them for marketing unless the guest has separately agreed.

14.2 You must comply with the Personal Data (Privacy) Ordinance (Cap. 486) when handling guest data.

15. Suspension and removal

15.1 We may suspend or remove a listing or host account if you break these terms, if we receive credible safety or legal complaints, if you cancel bookings repeatedly, if your verification fails or if we suspect fraud.

15.2 Where we can, we will tell you why and give you a chance to respond. We may act immediately where there is a risk to guests' safety.

15.3 If your account is suspended, we will decide with you how existing confirmed bookings are handled. Guests whose bookings are cancelled receive a full refund.

16. Liability and indemnity

16.1 You are responsible for your venue and for what happens there, except where caused by us.

16.2 You agree to compensate us for losses, claims and costs arising from your breach of these terms, or from your venue's failure to comply with the law.

16.3 Our total liability to you is limited to the greater of the commission we received for the booking concerned and HK$500. Nothing in these terms limits liability that cannot be limited under Hong Kong law.

17. Changes, ending and governing law

17.1 We may update these terms. For material changes, we will give at least 14 days' notice by email.

17.2 You can stop hosting at any time by removing your listings, once your confirmed bookings have been completed or cancelled under these terms.

17.3 These terms are governed by the laws of Hong Kong. The courts of Hong Kong have non-exclusive jurisdiction.

17.4 These terms are available in Chinese and English. If the two versions differ, the English version prevails.
